TotalEnergies Defends Energy Transition Record After Paris Greenwashing Verdict

The company said it will not appeal the ruling but will replace the flagged statements with more factual descriptions of its accomplishments.

TotalEnergies highlighted that the court dismissed most of the claims brought against it, including arguments about a communication campaign tied to the company's 2021 name change, its promotion of gas as a less carbon-intensive fossil fuel, and its promotion of biofuel as a low-carbon alternative. The company characterized the ruling as narrow in scope, applying only to three paragraphs on the customer website of its French subsidiary. The court ordered TotalEnergies to remove claims such as its ambition to achieve carbon neutrality by 2050 and its description as a major player in the energy transition, giving one month before EUR 10,000 per day fines apply.

In its response, TotalEnergies outlined a range of energy transition activities it described as evidence of genuine progress: more than EUR 20 billion invested in low-carbon energy globally since 2020, electricity production from near-zero in 2020 to 50 TWh currently, 32 GW of gross installed renewable energy capacity, nearly 1,900 EV charging points in France, construction of France's largest-ever offshore wind project representing a EUR 4.5 billion investment, and greenhouse gas emissions from oil and gas facilities reduced by 36% between 2015 and 2024, with methane emissions reduced by 55% since 2020.

The TotalEnergies case reflects a widening gap between the ambitions companies articulate in sustainability communications and the evidentiary standards courts are beginning to apply to those claims.
